A practical patent design-around process for power tools

A real design-around is not a color change or a minor dimension adjustment. It turns essential claim elements into engineering problems that can be redesigned.

The goal is not merely to “look different.” A meaningful design-around creates a material difference in essential claim elements, combinations, or implementation paths while still meeting product function and manufacturing constraints.

Step 1: define the target patents and target product version

Break the competitor product into functional modules, then build the relevant patent families. Do not rely on one Chinese patent alone, and do not treat every structure shown in the specification as if it were the legal scope of protection.

Step 2: break down independent claims

Decompose the independent claims into essential technical elements and map them to parts, positions, connections, motions, and functional relationships in the product.

Step 3: turn high-risk elements into innovation tasks

Possible directions include changing the load path, power-transmission path, relative position of components, trigger logic, sealing path, retention method, or relationships between modules. The actual path depends on the project.

Step 4: engineering validation + second search

The redesigned structure must still be checked for cost, durability, assembly, dimensions, performance, and supply-chain feasibility. A second search is then needed to determine whether the new path enters the scope of another group of live patents.

Step 5: turn the new structure into your own asset

If the alternative solution creates a new technical effect and has room for extension, patent strategy should be evaluated in parallel rather than added after the product is fully frozen.
